Biography

Yada Yuwataepakorn is a partner in the Dispute Resolution Practice Group at Baker McKenzie's Bangkok office, with significant experience handling general commercial litigation, restructuring and insolvency matters, criminal proceedings and crisis management. She joined the Firm in 2012 and has since been instrumental in some of the most high-profile cases. Beyond her legal practice, Yada frequently authors articles and gives presentation on restructuring and insolvency law.

Yada was awarded Rising Star in Restructuring and Insolvency by The Legal 500 Asia Pacific in 2024.

Yada's practice focuses on complex commercial litigation, project-related disputes, restructuring and insolvency, as well as legal implications arising from crisis and incidents in clients' businesses under civil, criminal and administrative law. Yada has represented and advised clients across diverse industry sectors, including energy, oil and gas, financial institutions, securities companies, hotels and multinational corporations.

Representative Legal Matters

  • Represented a listed insurance company on exposed liabilities that arose from offering to alleviate the burden on the government and public sector by offering the Personal Accident and Health Policy for COVID-19 Pandemic for sale. This was precedent among banks, insurance companies and securities companies under government agency regulations to enter into business reorganization proceedings.
  • Represented Thailand's national flag carrier in its business reorganization proceedings following financial difficulties subsequent to the outbreak of COVID-19 and acting as the client's legal advisor in various matters, ranging from day-to-day activities to overall operations, encompassing all aspects relevant to the client both within Thailand and in other jurisdictions.
  • Represented two petroleum refinery companies in handling legal implications arising from oil spill incidents off the Thai coast, as well as the relevant civil, criminal and administrative claims, and other regulatory issues.
  • Represented multiple securities companies in handling legal implications arising from an industry-wide incident due to securities fraud committed by an individual posing as a buyer of shares. This matter also involved proceedings under criminal and anti-money laundering law, as there existed suspicion from the Anti-Money Laundering Office of share price manipulation and public fraud.
  • Represented a foreign industrial waste management provider in an unprecedented case involving detected radioactivity, leading to the initiation of criminal investigations and management of the radioactive waste in cooperation with the Office of Atoms for Peace.
  • Represented a global energy company in response to a critical offshore incident, including providing strategic advice on promptly navigating the situation, managing fact-finding processes, assessing potential adverse effects on the environment and implementing measures to mitigate risks and potential liabilities.
  • Provided legal advice on contract management for the construction of power lines in an industrial estate zone, as well as in regard to the client's right to claim penalties under the contract and strategies to mitigate risks associated with potential counterclaims.
  • Defended the world's largest ship-building and oil-platform manufacturer in a USD 130 million claim involving damage to offshore pipelines. The work also involved lodging counterclaims against the project owner in relation to the EPC contract and lodging a claim against the insurer.
  • Represented a listed power plant company in their defense on trade secrets infringement. The plaintiff who was a former concessionaire claimed the revenue of approximately USD 2.2 billion generated from the power and mining project which the client invested in a foreign country.
  • Represented a group of power companies in several administrative disputes concerning the construction of various power plants. The disputes related to specific laws governing the construction and energy industries, including social and environmental impacts and town planning. This matter has included assisting the client in successfully challenging an injunction petition, thereby enabling the client to continue the construction of power plants.
