Biography

Jay Patel is an associate in Baker McKenzie's Litigation and Government Enforcement practice group and resides in the Firm's Houston office.

Practice Focus

Jay is an experienced litigation associate who represents and advises clients on all aspects of complex business and commercial litigation matters with a focus on energy, construction, and breach of contract disputes. Jay’s practice also extends to securities litigation, privacy litigation, business torts, partnership disputes, and other general contractual matters. Jay’s practice encompasses nearly all aspects of litigation, and he regularly assists with trial strategy and is well-versed in representing clients in all litigation phases in state and federal court.

In addition, Jay advises businesses across sectors on artificial intelligence, cybersecurity and privacy compliance matters and provides practical and actionable advice on complex and evolving privacy regulations with a focus on CCPA/CPRA and GDPR. His experience includes assisting with data breach response, global privacy compliance reviews and advising on cybersecurity and privacy risks in mergers and acquisitions.

Representative Legal Matters

Prior to joining the Firm, Jay handled the following matters:

  • Represented limited partners in arbitration proceeding concerning a partnership dispute over EPC of an NGL plant in South America.

  • Defended power trading company against peaking power plants in a USD 100 million breach of contract claim concerning interpretation of heat rate call option contracts following Winter Storm Uri.

  • Represented EPC contractor preventing counterparty from drawing USD 75 million on a standby letter of credit.

  • Represented crude supplier in breach of contract dispute concerning the purchase and sale of crude in Texas state court.

  • Represented a cryptocurrency lending platform in class action and customer litigation in the Northern District of California, and individual cryptocurrency disputes in Texas and Florida.

  • Represented numerous companies in disputes related to the development and construction of wind and solar projects, including ongoing lawsuit in Texas federal court.

  • Advised Fortune 50 publicly traded technology company on implementation of Web 3.0 technologies, including blockchain, NFTs, cryptocurrencies, tokens and DAOs.

  • Advised Fortune 50 publicly traded technology company on breach response in over 24 global jurisdictions, including 50 US states, Puerto Rico, the UK and the EU, as well as proactively advising on privacy for the development of advanced new products.

  • Advised insurers, investment companies, and banking and financial services corporations regarding the effectiveness and regulatory acceptability of their cybersecurity/privacy plans, programs and policies.

  • Advised businesses across sectors on cyber and privacy issues as part of mergers, acquisitions and asset sales, as well as for third party due diligence.
