Biography
Practice Focus
Joris has extensive experience in commercial litigation and international arbitration on a wide variety of subjects international arbitration. He represents a wide variety of clients before Dutch courts of all levels, including the Supreme Court. His practice focuses on the bigger and more complex cases, including (inter alia) construction litigation and arbitration, follow-on damages litigation, post-M&A litigation and the termination of continuing performance contracts.
As part of his Supreme Court practice, he has advised and represented clients on a wide variety of subjects, including the interpretation of various EU law instruments, employment law and procurement law.
Joris regularly teaches courses at the Law Firm School, the educational program for starting lawyers of larger law firms in the Netherlands.
Joris has registered the following principal (and secondary) legal practice areas in the Netherlands Bar’s register of legal practice areas (rechtsgebiedenregister): Civil procedural law, Arbitration, Litigation and attachment and execution law (Burgerlijk Procesrecht, Arbitration, Litigation en Beslag- en Executierecht).
Based on this registration, he is required to obtain ten training credits per calendar year in each registered principal legal practice area in accordance with the standards set by the Netherlands Bar.
Representative Legal Matters
- Represented ENECO Holding N.V. in litigation against the State of the Netherlands in order to overturn legislation that requires vertically integrated energy companies to separate their grid managers from the production and sales companies on the basis that it contravenes European and international law.
- Represented a large sports clothing brand in WIPO arbitration related to the termination of a supply agreement.
- Represented various clients in post M&A litigation and ICC arbitration related to indemnity liabilities and earn out or deferred payment issues.
- Represented various clients in ICC construction arbitration on (inter alia) the construction of petrochemical plants, waste management plants and infrastructure.
- Represented Alpro before the Supreme Court against NZO in relation to Regulation 1308/2013 and product descriptions used on packaging and marketing of plant based alternatives to dairy products.
- Represented various clients before the Supreme Court in employment related issues.
- Represented a client before the Supreme Court in a procurement dispute related to the existence of a ‘material change’.
- Represented a number of clients in follow-on litigation, including in cases following the fines imposed after the lifts, bitumen and ethylene cartels.
