Biography

Sonali is an associate in Baker McKenzie's North America Litigation and Government Enforcement Group and is based in our Palo Alto office.

Practice Focus

Sonali concentrates her practice on complex commercial litigation and arbitration matters. She handles a variety of disputes, including trade secret misappropriation, contract disputes, indemnity claims, privacy and data security, and other statutory and common law claims.

Representative Legal Matters

Prior to joining the Firm, Sonali advised on the following matters:

International Arbitration

  • Appeared before the Supreme Court of India, in a landmark decision on the enforceability of an unstamped arbitration agreement at the stage of arbitrator appointments.
  • Appeared before the Supreme Court of India, in a landmark decision distinguishing the ‘seat’ and ‘venue’ of arbitration. 
  • Represented the former shareholders of an oil/gas company in the enforcement of an investment treaty award (USD 50 billion) in India.
  • Represented Indian shareholders of a leading manufacturer of wind turbines in an international commercial arbitration involving complex issues of technology transfer and shareholder rights. 
  • Represented an American EPC contractor in an international commercial arbitration, in a claim of approximately USD 78 million relating to the construction and operation of a greenfield solar power plant.
  • Represented and advised an Indian conglomerate in a dispute with a Canadian company arising from a supply agreement of liquefied natural gas.
  • Represented one of India’s largest multinational conglomerates in an international commercial arbitration administered by the SIAC about disputes involving the valuation of shares in a joint venture company.
  • Represented one of India's largest integrated media companies in an international commercial arbitration against a Thailand-based satellite operator, relating to the use of transponder services on a satellite.
  • Successfully represented India’s largest steel producing company in a claim of USD 20 million, under an all-risk insurance policy for losses arising from an accident in a blast furnace.
  • Represented a leading port infrastructure company in India in several arbitrations arising from agreements with port authorities in West and East India. One key dispute related to a breach of contract in the construction and operation of a multi-purpose cargo handling berth, where the value of the claim and counterclaim was approximately USD 550 million. 
  • Represented an international auto parts manufacturing company in a cross-border dispute regarding control of an Indian joint venture company, which involved a Singapore seated arbitration, proceedings in India and before the English High Court. The India proceedings involved issues of interim relief by an Indian court in a foreign seated arbitration, and stay of enforcement proceedings due to pending company law proceedings.

Commercial Litigation

  • Represented a producer's association against the Telecom and Regulatory Authority of India in proceedings challenging certain regulations and tariff orders imposing restrictive conditions on the price of a bouquet of television channels.
  • Represented India's largest digital healthcare platform in relation to the regulatory aspects and operations of their e-commerce business in various High Courts in India.
  • Represented one of India’s largest gaming and hospitality companies in a constitutional challenge against the revocation of the in-principle approval for the installation of electronic games/ slot machines in a five-star luxury resort constructed by the company.
