
Oskar Marszałek
Biography
Oskar Marszałek is an advocate and senior associate in the Dispute Resolution and Arbitration team at Baker McKenzie's Warsaw office.
He is experienced in handling commercial and post-M&A disputes, both before regular courts and arbitration tribunals. Oskar is also highly regarded for his experience in criminal law, particularly white-collar crime proceedings.
His passion for arbitration extends to participating in prestigious international moot court competitions. Oskar actively engaged in the Willem C. Vis International Commercial Moot, the FDI International Arbitration Moot and the Frankfurt Investment Arbitration Moot Court. Notably, after graduating from the Jagiellonian University in Krakow, he also served as a team coach for the FDI International Arbitration Moot.
Oskar joined Baker McKenzie in 2017, bringing with him prior experience from several international law firms based in Warsaw. Since 2021, he has been a member of the Warsaw Bar Association.
Oskar is recognized by the Legal 500 EMEA as a key lawyer of the Dispute Resolution team at Baker McKenzie's Warsaw office.

- Represented as a lead attorney an European multi-energy holding in three cross-border ICC arbitration proceedings concerning a multidimensional post-M&A dispute of a value exceeding 150 million in total.
- Represented as a lead attorney a large Italian investor in the post-arbitration court proceedings in a post-M&A dispute and related civil, enforcement and criminal proceedings.
- Advised and worked on the case in the ICSID investment arbitration proceedings and ICC commercial arbitration proceedings against an Asian state in the large dispute concerning the construction and investment in deep-sea seaport.
- Represented a Latvian company in a dispute against the board members of limited company for the unsatisfied liabilities of that limited company.
- Represented a Polish company in the dispute against its former board member and the company officer for the breaches of their fiduciary duties.
- Represented an American IT company in the arbitration and various post-arbitration proceedings in a post-transactional IT dispute.
- Represented four banks in disputes concerning mass consumer claims relating to foreign currency indexed and denominated loans.
- Advised a European bank in the large investment dispute against a European state concerning the state’s violations of the legitimate expectations of the bank, inconsistent treatment and denial of justice.
- Represented multiple clients in the commercial criminal proceedings and fiscal criminal investigations and court proceedings.
