Biography

Nont Horayangura is a partner in Baker McKenzie Bangkok's Intellectual Property and Technology practice group. He has more than 25 years of experience representing a wide range of business and institutional clients in various IP and Technology matters.

Nont is a Certified Information Privacy Professional Europe (CIPP/E) by the International Association of Privacy Professionals (IAPP). Nont currently serves as a Council Member of the Asian Patent Attorneys Association (APPA) Thailand Group and a board member of the Intellectual Property of Thailand Association. In 2024, Nont was appointed by the Cabinet to be a Member of the Copyright Board under the Copyright Act for providing advice and consultation to the Minister of Commerce and decide relevant appeals.

Practice Focus

He regularly advises multinational and local clients on legal issues surrounding strategic IP and technology protection plans and IP commercialization and exploitation through various forms of agreement e.g. licensing, distributorship, franchising, joint and development, etc. Nont leads our IP enforcement team in pursuing/defending/litigating all types of cases and disputes in court over a wide range of jurisdictions. He also leads the IP international registration team to protect and manage clients’ global IP portfolios. He has extensive experience as lead counsel for cross-border IP and technology disputes and court trials, working with local teams in many countries around the world.

Nont advises multinational technology, platform, banking, social media, telecommunications and consumer product industry leaders on regulatory issues and contracts related to AI, information and telecommunications, cloud computing, automation systems, telematics construction of telecommunication towers, outsourcing, support and maintenance services, e-commerce, advertising laws, etc.

Nont is a data protection and privacy law specialist, advising on cybersecurity and data protection matters. He assists multinational and local clients in various industries on regulatory issues and preparation for compliance with Thai data protection and privacy laws. Nont provides data protection advice on an end-to-end approach, including security by design as well as measures when cybersecurity breaches occur, such as cooperation with relevant experts for investigation, data forensics, publication and litigation. He has led numerous in-depth corporate seminars for clients in connection to the passage of the EU GDPR and the Thai PDPA.

Representative Legal Matters

Intellectual Property

  • Team leader advising the US trade association for the filming industry for analysis of the regulatory environment relating to Artificial Intelligence.

  • Team leader, working with the Baker McKenzie San Diego Office to represent a major ‘free to air’ TV channel in Thailand in filing a copyright and trademark case in Los Angeles and Bangkok against an illegal distributor resulting in a favorable multimillion dollar jury verdict in the US, and a favorable multimillion Baht award by the Supreme Court of Thailand.

  • Lead counsel advising the world's largest convenience store chain in managing and protecting their valuable IP rights in Thailand as well as their commercial agreements with their franchisees.

  • Representing TV production companies, the country's largest cable TV operator and a Thai convergence service provider in regard to the preparation of agreements for co-production of TV programs, content licensing for English Professional Football League competition programs and commercial launch of state-of-the-art digital products and services, respectively.

  • Lead counsel advising an international hotel chain with 20 iconic brands in more than 80 countries around the world on licensing issues regarding their IP in Thailand and advising a leading Thai-based property developer for the management and protection of their trademarks in Thailand and overseas.

  • Managing inbound trademark portfolios for many of the world’s most recognizable and identifiable brands and companies.

  • Managing the Thai trademark portfolios of numerous global companies in a wide variety of industries.

  • Assisting clients with prosecution, registration, opposition, cancellation, litigation, use & registrability searches, and publication of trademarks both locally and globally.

Data Privacy

  • Team leader for projects regarding GDPR and PDPA compliance for financial institutions in Thailand including the Thai Bankers Association.

  • Team leader for projects regarding PDPA compliance for international airlines; world famous food franchisors; a US-based world leading hardware manufacturer, etc.

  • Team leader for advising local and multi-national data breach incidents.

  • Advised a major fashion label with a new fraud risk management solution from a data privacy perspective.

  • Assisting various sizes of companies in responding to cybersecurity incidents, including security breaches, ransomware attacks, fund transfer fraud and data breaches.

  • Leading and coordinating with clients through high-profile cross-border investigations, enforcement matters, and cybersecurity incidents, as well as providing comprehensive guidance on cybersecurity risks, breach readiness and data security issues.

Technology

  • Team leader in an emerging technology project with a government agency to help develop, support and promote electronic transactions. Prepared the consultation papers for public hearings and the subsequent recommendation papers on regulations for AI and Data Sharing.

  • Advised major telecommunications service providers from the US and China on the establishment of a Thai subsidiary and the preparation of legal guidelines, licensing, regulatory requirements and compliance issues.

  • Team leader in contract negotiations for the Stock Exchange of Thailand for the implementation of cutting edge trading platforms for the institution.

  • Advising leading Thai commercial banks and the Bank of Thailand for the technology transfer in the first blockchain project in the Thai financial industry.

  • Team leader for advising one of the largest financial group of companies in preparation of AI Technology Research and Development Collaboration Agreement.

  • Representing a leading British telecommunications operator in the global outsourcing project for the Dutch-based world's largest conglomerate company for its Thailand operation.
