Biography

Erik Forsin is a partner and heads Baker McKenzie’s Dispute Resolution Practice Group in Stockholm. He joined Baker McKenzie in 2020. Prior to joining the Firm, he worked at the Stockholm office of another global law firm. He graduated from Stockholm University (LL.M., jur.kand.) in 2008. He also has experience from working in Swedish Courts and the Swedish Enforcement Agency. In addition to acting in commercial disputes Erik serves as an arbitrator and has completed the SCC Institute and Swedish Arbitration Association Arbitrator Training Program (Class of 2021/2022).

Practice Focus

Erik focuses primarily on international and domestic arbitration and litigation for Swedish and foreign companies with a particular emphasis on disputes within the fields of contentious M&A, company law, banking & finance and contractual disputes. He has been lead counsel in numerous arbitrations, mainly under the SCC Rules and ad hoc as well as co-counsel in several Sweden seated arbitrations under foreign laws. Erik has tried cases in all major courts in Sweden, including four cases before the Swedish Supreme Court.

Erik writes and speaks regularly on topics related to international arbitration in Sweden as well as other Swedish law issues.

Representative Legal Matters

  • Represented purchaser in an arbitration regarding termination and right to repayment of deposit in connection with a 21 million GBP share purchase agreement.
  • Represented shareholder in an arbitration regarding right to compulsory purchase of shares due to breach of a shareholders agreement.

His experience prior to joining the Firm includes:

  • Represented Swedish bank in the Swedish Supreme Court regarding the legal validity of pledge of agricultural subsidies from the EU.
  • Advised Third Party Funder in relation to possible financing in international investment treaty dispute.
  • Represented international medical company's Swedish subsidiary in arbitration and challenge procedures regarding payment of additional purchase price according to a share purchase agreement.
  • Represented private equity fund owned company in pilot case arbitration proceedings relating to its incentive program.
  • Reoccurring representation for Swedish banks and financial institutions in disputes regarding project financing and factoring.
