Biography

Milad Fayez is a senior associate at Helmy, Hamza & Partners, Baker McKenzie Cairo. He focuses his practice on dispute resolution, compliance, investigation and real estate. Milad is experienced in attending and pleading before the courts, and in preparing writs of summons and defense memos before the courts of the state council, the court of cassation, the economic courts and the civil courts. Milad is also experienced in real estate registration, notarization and mortgage. He received his LLB from Monofia University in 1994. Milad has been admitted to the Egyptian Bar Association in 1995.

Representative Legal Matters

  • Acting for client in connection with a dispute against the Ministry of Finance. The Ministry of Finance is claiming that the ice cream offer that took place prior to the divestment (buy 1, get 1 free) was subject to Stamp Duty Tax. The conflict was raised before the Tax Appeal Committee where a decision was held in favour of the Company. However, the Ministry of Finance initiated a court case. Currently, before the State Council and still pending on receiving the expert's report. The Antitrust team with the cooperation of the litigation team prepare the memorandum of defences, attend the experts' session and respond and argue the claims presented and submitted by the claimant during before the experts' committee.

  • Represented a mineral exploration, development and mining company regarding a lawsuit on the invalidity of the agreement for gold prospecting signed with the Egyptian Government. The lawsuit aimed to challenge the decision of the agreement and to annul the agreement itself. A judgment has been rendered in favor of the company.

  • Representing an international financial institution concerning lawsuits, still being reviewed before the courts, regarding the sale of 80% of an Egyptian bank shares, requesting cancelation of the sale and privatization process of the company's share in the Egyptian bank.

  • Representing an international steel producer as a defendant of the lawsuit, still being reviewed before the courts, filed by the Egyptian National Railways against the company, requesting to obligate the company to pay EUR 2,344,750 in addition to the legal interest.

  • Representing an Egyptian telecommunication company as a defendant of a lawsuit, filed against the company, requesting cancellation of the sale and privatization process of 20% of the company's shares. A judgment has been rendered in favor of the company.

  • Represented an Egyptian media group, as plaintiff of the lawsuit, still being reviewed before the Cairo Economic Court of Appeals, filed by the company against an artist, requesting to obligate her to pay EGP 4.7 million in addition to the legal interest.

  • Represented a leading Egyptian company grain trading and marine services in connection with a dispute before the Investment Dispute Settlement Committee against Alexandria Port Authority regarding storage fees.

  • Represented one of leading companies for poultry production in the Middle East in connection with a dispute before the Investment Dispute Settlement Committee against New Urban Communities Authority regarding the right to register a land in Wadi El Natroun area.

  • Representing a multinational technology company specializing in Internet-related services and products with respect to an ongoing litigation.

  • Represented the global gold producer Centamin Egypt Limited in connection with a high profile case regarding the appeal of a judgment issued by the Administrative Court annulling the exploitation lease granted by the Egyptian Government with respect to the exploitation of the Sokari Gold Mine before the Council of State.

  • Represented Egypt's Main Fixed Line Telecommunications Company in connection with many disputes regarding interconnection agreements.
