Biography

Nicholas (Nick) Corsano is a partner in the Employment & Compensation practice, based in the Firm’s New York office. With a track record of successfully defending clients against a wide range of employment claims, Nick provides employers with strategic counsel on labor and employment issues, including workplace policies, agreements, and compliance. His practice extends to developing and conducting targeted trainings that ensure organizations meet local legal requirements, helping clients minimize risk and foster positive workplace environments. Nick’s comprehensive approach and effective advocacy make him a trusted advisor for businesses navigating complex employment challenges.

Nick was named by Crain’s New York Business as a “2024 Notable LGBTQIA+ Leader”.

Practice Focus

Nick focuses his practice on labor and employment litigation and counseling, representing clients in federal and state employment disputes alleging discrimination, harassment, retaliation, breach of contract, whistleblowing, trade secret misappropriation, restrictive covenant violations, wage and hour class and collective actions and other employment matters, including those involving Title VII, ADEA, ADA, FLSA and related state/local statutes. He handles actions brought through alternative dispute resolution programs, state and federal courts, and before administrative agencies. Nick also advises on employment matters such as leave requirements, disability accommodations, complex employment agreements, employment policies and procedures, and employee discharge and discipline.

Nick also has experience handling single-plaintiff and class action litigations concerning other complex commercial disputes.

Prior to joining Baker McKenzie, Nick advised on the following matters:

  • Achieved dismissal at summary judgment of federal and state wage and hour claims brought against software company.
  • Achieved dismissal at summary judgment of breach of employment contract claims brought against healthcare company.
  • Prevailed on a Motion to Dismiss claims of age discrimination brought against leave management company.
  • Prevailed on a Motion to Dismiss claims of sex and disability discrimination brought against a media company.
  • Prevailed on a Motion to Dismiss federal and state off-the-clock claims against retailer.
  • Achieved dismissal at summary judgment of age discrimination claims brought against landscaping company.
  • Secured dismissal of New York state agency complaint alleging race discrimination at Charge stage.
  • Secured dismissal of Connecticut state agency complaint alleging sex discrimination at Charge stage.
  • Prevailed on a Motion to Dismiss claims of religious discrimination brought against a national retailer.
  • Prevailed on a Motion to Dismiss sex discrimination claims brought against a national retailer.
  • Assisted in obtaining settlement regarding claimed violations and citations of the New York City Earned Sick Time Act.
  • Defended multiple restaurants against claims of ADA public accommodation violations.
  • Defended a fitness organization against claims of race discrimination.
  • Obtained settlements of putative class and collective action claims under the FLSA and state laws alleging misclassification and unpaid overtime.
  • Obtained settlements of putative class and collective action claims under state laws alleging untimely payment claims.
  • Obtained settlements for clients in numerous single-plaintiff cases alleging various forms of discrimination, harassment, failure to accommodate and/or retaliation under federal, state and local law.
  • Secured dismissal of eight single-plaintiff claims against retail client alleging discrimination and wage and hour violations.
  • Obtained settlement of alleged breach of employment contract dispute.
