Biography

Nicholas (Nick) Corsano is a New York-based partner in Baker McKenzie’s Employment & Compensation Practice Group. He advises employers across a broad range of labor and employment matters, drawing on significant litigation experience to provide practical, business-focused guidance on workplace policies, agreements, compliance and training.

Nick was named by Crain’s New York Business as a “2024 Notable LGBTQIA+ Leader”.

Practice Focus

Nick's practice focuses on representing employers in complex federal and state employment disputes, including claims involving discrimination, harassment, retaliation, breach of contract, whistleblower protections, trade secret misappropriation, restrictive covenant enforcement, and wage and hour class and collective actions. He regularly handles matters arising under Title VII, the ADEA, the ADA, the FLSA and analogous state and local laws. Nick represents clients in arbitration and other alternative dispute resolution proceedings, as well as in state and federal courts, and before administrative agencies.

Beyond litigation, Nick serves as a strategic advisor to employers on a broad range of workplace issues, including leave and accommodation obligations, complex employment agreements, workplace policies and procedures, employee discipline, and terminations. He also designs and delivers tailored training programs that promote compliance, mitigate legal risk, and support effective workplace practices. In addition, Nick has experience handling complex commercial disputes, including both single-plaintiff and class action litigation.

 

Representative Legal Matters

  • Obtained settlement of alleged breach of contract claims
  • Completed independent investigation of internal complaints concerning personnel issues
  • Completed independent investigation into claims of unfair treatment
  • Assisted in completion of wage audit resulting in no issues being found
  • Obtained dismissal of claim alleging unpaid sick time

Prior to joining Baker McKenzie, Nick advised on the following matters:

  • Achieved dismissal at summary judgment of federal and state wage and hour claims brought against software company.
  • Prevailed on a Motion to Dismiss claims of sex and disability discrimination brought against a media company.
  • Prevailed on a Motion to Dismiss federal and state off-the-clock claims against retailer.
  • Secured dismissal of New York state agency complaint alleging race discrimination at Charge stage.
  • Assisted in obtaining settlement regarding claimed violations and citations of the New York City Earned Sick Time Act.
  • Defended multiple restaurants against claims of ADA public accommodation violations.
  • Obtained settlements of putative class and collective action claims under the FLSA and state laws alleging misclassification and unpaid overtime.
  • Obtained settlements of putative class and collective action claims under state laws alleging untimely payment claims.
  • Obtained settlements for clients in numerous single-plaintiff cases alleging various forms of discrimination, harassment, failure to accommodate and/or retaliation under federal, state and local law.
  • Secured dismissal of eight single-plaintiff claims against retail client alleging discrimination and wage and hour violations.
