Biography

Frederick (Rick) Capossela is an associate in the Tax Practice Group of Baker McKenzie’s New York office. Prior to joining the Firm, Rick worked for a boutique tax law firm.

Practice Focus

Rick focuses his practice on state and local tax controversy and compliance matters, including audit defense, administrative appeals, and litigation support. His experience spans state income and sales tax issues, supporting settlement negotiations, and advising on uncertain tax positions and refund opportunities.

Representative Legal Matters

Prior to joining Baker McKenzie, Rick advised on the following matters:

  • Managed appellate litigation process before New York Tax Appeals Tribunal regarding sales tax imposition on Fortune 500 services company.
  • Managed administrative appeal process contesting California localities imposition of utility user taxes on video streaming providers.
  • Represented global pharmaceutical manufacturer in refund action contesting New York City’s treatment of global intangible low taxed income.
  • Defended New York state personal income tax audit for CEO of New York City based investment fund related to state conformity to federal tax code.
  • Represented mass media and entertainment conglomerate in corporate income tax settlement negotiations with the Pennsylvania DOR regarding the proper sourcing methodology for its revenue streams.
  • Advised international offshore wind farming business on its corporate income and sales tax reporting requirements as the company expanded its operations into the US for the first time. 
  • Managed Massachusetts domicile audit for high-net-worth individual client, resulting in “No Changes” letter from DOR affirming client’s as filed return position.
