Biography

Brian Bornhoft is a mid-level associate in Baker McKenzie's Litigation & Government Enforcement practice group in Chicago, Illinois. Brian has advised clients in domestic and international commercial litigation, securities litigation, white-collar investigations, and bankruptcy litigation.

Brian graduated from the University of Chicago Law School with Honors, during which he served on the board of The University of Chicago Law Review, externed for U.S. District Judge Marvin E. Aspen of the Northern District of Illinois, externed for the American Civil Liberties Union of Illinois, and participated in the Edwin F. Mandel Legal Aid Clinic.

  • Represented a specialty chemicals company in litigation involving trade secret misappropriation, breach of contract, and breach of fiduciary duty claims and secured a USD 70 million judgment.
  • Represented a biopharmaceutical company in an SEC investigation and obtained a declination of enforcement.
  • Represented an executive of an agricultural company in parallel SEC and DOJ investigations that were resolved without action against the executive.
  • Advised buyers and sellers on litigation, Foreign Corrupt Practices Act (FCPA), and anti-money laundering (AML) risk in multi-billion dollar M&A transactions.  
  • Represented a commercial bank with peak deposits of USD 200 billion in Chapter 11 bankruptcy proceedings.
  • Represented an education technology company with a peak valuation of USD 22 billion in Chapter 11 bankruptcy proceedings.
  • Represented international fund managers in defending against fraudulent transfer claims.
  • Advised a public housing authority regarding compliance with obligations imposed under a consent decree.
  • Obtained grants of asylum for multiple clients fleeing persecution in their countries of origin.
  • Represented a civil rights plaintiff in an action under 42 U.S.C. § 1983 and secured a favorable settlement.
