Biography

Carmen is a partner in the Madrid office. She joined Baker McKenzie as an associate for the Dispute Resolution Department in 2009, where she mainly practices in commercial and civil litigation.

Before Carmen joined the Firm, she was a member of the litigation team at another renowned law firm in Spain.

Practice Focus

She has undertaken the legal counselling and procedural defense of both national and foreign companies in both litigation, arbitration (both domestic and international), out-of-Court claims and settlement agreements. She has a vast experience in the main areas of civil and commercial law, including, amongst others: contractual law, tort, insurance contracts, corporate disputes, agency and distribution agreements, insolvency matters and cross-border disputes, amongst others.

Representative Legal Matters

Experience in domestic and international arbitration

Acting as counsel in the following arbitrations:

  • Filing of three arbitration proceedings before the Spanish Court of Arbitration, on behalf of a technology multinational, claiming specific performance of a Consortium Agreement entered into with the defendant companies for the construction of the Medina-La Meca AVE (2017 and 2018).
  • Defence of Spanish telecommunications company against the corporate liquidation claim filed by another partner before the Court of Arbitration of the Madrid Chamber of Commerce and Industry (2017).
  • Filing of arbitration proceedings on behalf of an Israeli company before the ICC against a Spanish multinational electricity company, claiming the know-how fee provided for in the joint venture agreement signed between the two entities for the promotion of thermo-solar projects in Spain (2012).
  • Defence of a multinational wind power company against an arbitration claim brought before the ICC by a Mexican electricity company for damages based on the alleged breach of a wind turbine supply agreement signed between the two companies (2020).
  • Defence of a pharmaceutical company against the arbitration claim brought before the ICC by a distributor for damages, based on the termination of the contract for the supply of poppy seeds signed between both entities (2012).
  • Filing of an arbitration claim on behalf of a multinational mining company before the Court of Arbitration of the Madrid Chamber of Commerce, against a Spanish collaborator, in relation to the exploitation of the Rio Tinto mines (2010).
  • Defending a US insurance company against an arbitration claim brought by a Peruvian insurer before the Court of Arbitration of the Madrid Chamber of Commerce, in the exercise of an alleged pre-emptive acquisition right over the shares of a company in which both parties have an interest (2010).
  • Defence of a technology multinational against an arbitration claim brought by wind farm developers based on breach of a supply contract before the Court of Arbitration of the Madrid Chamber of Commerce and Industry for 80 million euros (2021).
  • Defence of gas multinational against arbitration claim brought by electricity company based on breach of gas supply contract before the London Court of Arbitration for approximately 30 million dollars (2021).

Proceedings for annulment of the award:

  • Defence of a multinational gas company against a claim for annulment of an award rendered by the London Court of International Arbitration, relating to a contract for the supply of liquefied gas worth more than 100 million dollars per year (2020).
  • Claim for annulment of an award rendered by the Court of Arbitration of the Madrid Bar Association on behalf of a Romanian company against a Spanish company in connection with the termination of an urban development contract in Romania (2016).
