Baker McKenzie partner Elizabeth Roper was quoted in Bloomberg Businessweek on the outcome of the Peraire-Bueno cryptocurrency fraud trial, in which arguments around “code is law” took center stage.

Liz discussed how the case, which ended in a mistrial, illustrates the challenges of applying existing laws to crypto platforms. Liz commented that the trial’s outcome was a “signal that the ‘code is law’ argument has some validity.” She added: “Every case is unique, and these arguments are very fact-specific, but it certainly seems like that argument — that activity that is within the bounds of what the platform’s code allows isn’t fraudulent — has resonated with judges and juries.”
