Baker McKenzie associate, Daniel Graulich, recently authored, “Antitrust Analysis In Iowa Pathologist Case Misses The Mark,” which was published by Law360.

The piece focuses on Goldfinch Laboratory PC v. Iowa Pathology Associates PC, in which the US District Court for the Southern District of Iowa sided with the Defendant, granting defendants’ motion to dismiss on the ground that the plaintiff lacked statutory standing. In this in-depth case review, Daniel evaluates why courts should analyze conduct and market context before analyzing market effects. He then provides suggestions for how courts and parties can more effectively frame antitrust injury and antitrust standing analysis.
