Biography

Prof. Dr. Marc Gabriel is a lawyer, a specialist lawyer for medical law, for public procurement law and for administrative law and a partner in the Berlin office of Baker McKenzie. With over twenty years of professional experience, Prof. Dr. Gabriel co-heads the Public Law Practice Group and the Regulatory & Public Sector in Germany. He is an honorary professor at the Goethe-University Frankfurt am Main, a member of the specialist lawyers' committee for public procurement law of the Berlin Bar Association, editor and author of numerous specialist publications and standard works on public law and in particular on healthcare law and public procurement law. Prof. Dr. Gabriel has been named among the leading and most recommended lawyers in these fields for many years by JUVE, Chambers, Legal 500, etc.

Practice Focus

Prof. Dr. Gabriel's practice focuses on advising regulated industries on all public law, healthcare law and, in particular, public procurement law issues. He legally supports globally active companies as well as governments and state institutions in major projects affecting the public sector. He also advises and represents bidders and contracting authorities in procurement and review proceedings. Prof. Dr. Gabriel has more than 20 years of project experience and extensive industry expertise, particularly in the pharmaceutical and healthcare, infrastructure and transport, and defense and security sectors. Another focus of his advisory practice is the accompaniment of infringement proceedings, state aid review proceedings, public-private partnerships and privatisations as well as state selection/bidding procedures under European law.

  • Advising and representing international pharmaceutical companies, medical device manufacturers and commercial enterprises in connection with major procurement projects of the German Federal Government and the European Commission to address the COVID-19 pandemic.

  • Advising and representing leading global pharmaceutical companies as bidders in health insurance tenders and award review proceedings as well as in defending contractual penalty and damage claims of statutory health insurance companies due to supply shortfalls in the implementation of drug discount agreements with contract and litigation values in the billion euro range.

  • Advising a European government and several European defense ministries on the national implementation of the Defense Procurement Directive 2009/81/EC and on the award of various major defense-related projects.

  • Advising a leading pan-European passenger transport operator on public procurement and state aid law aspects with regard to the implementation and application of the Regulation 1370/07 on passenger transport services by rail and road.
