Peerapan Tungsuwan joined Baker & McKenzie in 1983 and has worked in the Firm’s Bangkok and Hong Kong offices. She currently leads the Asia-Pacific Regional Pharmaceuticals and Healthcare Group. Within the Bangkok office, Ms. Tungsuwan serves as lead partner in the Mergers & Acquisitions and Corporate & Commercial practice groups, co-leader of the Japanese Desk, and head of the Natural Resources (Oil, Gas and Mining), Pharmaceuticals, and Media & Entertainment practice groups, as well as the Consumer Products and Advertising & Marketing focus groups.

Ms. Tungsuwan is exceptionally fluent in legal matters relating to environmental law, consumer protection and pharmaceuticals matters. Her client list includes a Japanese-based Fortune 500 company, multinational manufacturers, pharmaceutical companies, and oil and gas companies. Ms. Tungsuwan assists clients in setting up business in Thailand, negotiating commercial contracts and complying with Thai regulatory requirements.

Representative Legal Matters

• Advised manufacturers on establishing manufacturing facilities, obtaining investment privileges and relevant governmental approvals and negotiating construction contracts.
• Drafted documents and reports for the pharmaceutical industry related to clinical studies, adverse event reports, assorted agreements, data protection and secrecy issues and product liability. 
• Advised on the Thai Drug Act and associated regulatory issues, including compulsory licensing. 
• Advised on advertising and marketing strategies, comparative advertising and marketing matters for highly-regulated industries. 
• Advised on the Kyoto Protocol and the potential for obtaining certified emission reductions (CERs), the application process and other relevant issues. 
• Provided ongoing legal advice to a Japanese-based Fortune 500 company on a range of corporate and commercial and customs issues in Thailand.
