Biography

Roberta Chan is a partner in Baker McKenzie's Hong Kong office and a member of our Dispute Resolution Practice Group.

Practice Focus

Roberta advises on all types of cross borders disputes, property related litigation as well as all aspects of commercial and corporate litigation including company and shareholder disputes, contract and tort claims. She also has extensive experience in insurance and contentious employment matters.

She is considered to have "developed a stellar reputation for significant property-related litigation, as well as corporate and commercial litigation including company and shareholder disputes." by The Legal 500 2023.

Roberta is a solicitor-advocate with rights to appear in all levels of civil courts in Hong Kong. She is also a member of the Civil Litigation Committee of the Law Society. She was appointed and sat as the District Court Temporary Registrar in January 2023.

Representative Legal Matters

Commercial / Corporate Disputes

  • Representing PRC parties in a shareholder dispute over the shares in a Hong Kong company which engages in the mining business in the PRC through various PRC subsidiaries. The value of the shares is more than RMB 92 million.

  • Representing and advising PRC parties in obtaining interim measures in aid of arbitration in the Switzerland Arbitration Centre.

  • Advising and successfully defending for a start-up eSports company and its majority shareholders in a shareholder dispute for over HKD 1.4 billion.

  • Representing and advising a high net worth individual in family disputes or trust/estate issues in Hong Kong and Macau.

Property Litigation

  • Acted for the property developer in defending claims for breach of sale and purchase agreements, breach of the deed of mutual covenants, and nuisance on the development up to the Court of Final Appeal level.

  • Acted for a high net worth individual in advising and defending his legal rights and position in the erection and maintenance of certain structures on the land.

  • Acted and advised a Swiss based retail manufacturer in its dispute with landlord over the market rent under the renewed term.

Employment Litigation

  • Represented and defended a major re-insurance company in a claim arising from team move.
  • Represented and defended a product retailer employer in a disability discrimination claim at the District Court.
  • Regularly advises on employment contract disputes such as post-termination obligations and discrimination claims.
