Shima S. Roy routinely works on litigation and arbitration matters. She has arbitrated disputes pursuant to the rules of the International Centre for Dispute Resolution (ICDR), American Arbitration Association (AAA) and National Association of Securities Dealers, and advises clients on drafting arbitration provisions in international transactions. She co-authored "The Attorney-Client Privilege & Conflicts of Interest in Negotiated Acquisitions", which she presented before the Business Law Section of the American Bar Association. In addition, Ms. Roy actively participated in panel discussions on international arbitration as part of the Firm’s North Carolina Initiative.

Ms. Roy has represented US and non-US clients in several federal and state courts, and has tried several jury cases to verdict. She handles a broad range of commercial and product liability cases — including contract litigation, distributor and dealer litigation, securities and licensing disputes — and is actively engaged in arbitration matters. Her track record in arbitration includes obtaining a multimillion award on behalf of a pharmaceutical manufacturer in an ICDR arbitration regarding a breach of contract dispute involving FDA approvals and royalty payments.
Representative Legal Matters
- Successfully defended a European master distributor of surgical products against over $5 million in claims for breach of contract, fraud and breach of fiduciary duty brought by manufacturer in ICDR arbitration.
- Successfully defended a major US Commodities Exchange before a three-member AAA panel against a $73 million claim alleging breach of a non-disclosure agreement disclosing concepts for derivative products.
- Represented a UK corporation in a post-acquisition litigation in New York State Court involving indemnification for costs associated with asbestos litigation filed against the acquiring corporation.
- Defended a Taiwanese manufacturer and its US subsidiary in a $1 billion claim pending in the Eastern District of Pennsylvania against breach of contract, breach of warranty and fraud claims for a component product integrated in a 911 system.
- Tried several jury cases to verdict on behalf of an elevator maintenance corporation in Illinois State Court against allegations of product defects and negligent maintenance of an elevator
- Represented a multinational corporation in a licensing agreement dispute filed in the Northern District of Illinois with its Australian joint venture partner and joint venture corporation.
