Biography

Lise Test is an of counsel in the Firm’s International Trade Group in Washington, DC and practices in the area of international trade regulation and compliance — with emphasis on US export control laws (Export Administration Regulations (EAR) and International Traffic in Arms Regulations (ITAR)), trade sanctions, and anti-boycott laws. Ms. Test advises clients on issues relating to product classifications, licensing, regulatory interpretations, risk assessments, enforcement actions, internal investigations and compliance audits, as well as the design, implementation, and administration of compliance programs.

Ms. Test works regularly with companies across a wide range of industries, including the pharmaceutical/medical device, telecommunications, manufacturing, and technology sectors. She joined the Firm as a summer associate in 2007 and became a full-time associate in 2008. Prior to joining Baker McKenzie, Ms. Test served as a lawyer at the Danish Ministry of Defence.

Representative Legal Matters

  • Provide general compliance advice on export controls and trade sanctions to clients, including advice on export control product classifications, export licensing requirements, application of trade sanctions in cross-border transactions, restrictions on dealings with blocked parties and blocked property, applicability of general licenses and license exceptions, and M&A due diligence.

  • Assist clients conduct internal reviews, gap assessments, and other compliance audits and design, implement, and administer compliance programs, including measures to ensure compliance with deemed export and encryption controls.

  • Assist clients conduct internal investigations and prepare voluntary disclosures to the Office of Foreign Assets Control (OFAC), the Bureau of Industry and Security (BIS), and the Directorate of Defense Trade Controls (DDTC).

  • Prepare and submit commodity classification and commodity jurisdiction requests with BIS and DDTC and prepare and submit license applications and advisory opinion requests with BIS, DDTC, and OFAC.

  • Counsel clients on the application of encryption controls, including the classification of items with encryption functionality, the availability of License Exception ENC, and related reporting requirements.

  • Provide advice on and review tenders, contracts, and other documentation for compliance with anti-boycott laws and regulations and assist clients prepare anti-boycott reports for submission to BIS.

  • Conduct training, webinars, and seminars on export controls and trade sanctions.
