David Zaslowsky practices in the area of general commercial litigation and arbitration. He has worked on many cases involving issues of international litigation and arbitration, including matters related to the Foreign Sovereign Immunities Act, enforcement of foreign arbitral awards, Alien Tort Claims Act, forum non conveniens, obtaining discovery in aid of foreign proceedings under 28 U.S.C. § 1782 and foreign attachments. Mr. Zaslowsky has been included in the Chambers USA Guide 2008, 2009 and 2010 rankings for his accomplishments in the field of international arbitration.

Practice Focus

Mr. Zaslowsky has appeared in various Federal and State courts — trial and appellate — throughout the country. He has also participated in arbitrations, both inside and outside the United States, under the rules of various arbitral institutions including the American Arbitration Association, International Chamber of Commerce, Iran-United States Claims Tribunal, International Centre for Dispute Resolution and NASD, as well as ad hoc arbitrations. Mr. Zaslowsky is also on the panel of international arbitrators of the International Centre for Dispute Resolution.

Representative Legal Matters

  • Bro-Tech Corp. t/a The Purolite Co. v. Thermax, Inc. –Represent an Indian company against charges of theft of trade secrets arising from its hiring plaintiff’s former employees.
  • Mendes Junior International Co. v Banco do Brasil – Represented a Brazilian bank in defending against an $800 million claim for breach of contract arising out of projects performed in Iraq.
  • U.S. Utility v Insurance Company – Represented a captive insurance company in arbitration and other forms of ADR in connection with disputes with an insured concerning whether certain damage at nuclear power plants are covered under the policy.
  • U.S. Bank Executive v German Bank – Represented a German bank in a claim (ICDR arbitration) by the former President of its US Representative Office for breach of a bonus provision in his employment contract.
  • M&M Packaging Inc. v Kole – Represent the Idaho Potato Commission in a 12-year old case relating to the Commission’s ownership of certification mark for Idaho potatoes. The case has gone through a jury trial and three visits to the Second circuit.
  • U.S. Coal Suppliers – Represent a number of US coal suppliers in a series of arbitrations concerning obligations under long-term coal supply contracts.
