Biography

L Andrew S. Riccio is a partner in the New York office and co-chair of Baker McKenzie's North American International Arbitration Group. Andrew represents clients in international and domestic disputes in federal and state courts throughout the U.S., as well as arbitrations before institutional (ICC, ICDR, LCIA, JAMS, AAA, ICSID, HKIAC) and ad hoc tribunals. Andrew also has experience litigating contested matters arising in the restructuring and insolvency context in bankruptcy courts.

Andrew serves on the New York-Miami Pro Bono Committee, organizing pro bono representation for the two offices and actively represents individuals and organizations on a pro bono basis in an array of areas.

Practice Focus

Andrew focuses his practice on international and domestic dispute resolution, with emphasis on the energy, financial services and travel sectors in an array of commercial and corporate disputes. Andrew frequently represents upstream, midstream and downstream oil & gas companies in international arbitration. He also acts for renewable energy companies, including as counsel to owners and contractors in construction disputes in relation to the construction of power plants. Andrew also advises clients in the travel industry, such as companies in the aviation industry, hotel owners and operators and online travel companies.

Fluent in Spanish, Andrew regularly advises clients from Latin America and Spain.

Representative Legal Matters

  • Represented a Spanish energy company in an ICDR arbitration relating to the construction of a wind farm project in Mexico.

  • Represented a Spanish energy company in an ICC arbitration relating to the construction of a combined cycle power plant in Mexico.

  • Represented an automobile distributor in ICC arbitration related to the sale of Japanese automobiles in Mexico.

  • Represented a European energy company in LCIA arbitration related to marine transport of LNG.

  • Represented an EU telecom company in ICC arbitration related to the viability of a contract with a Latin American subsidiary.

  • Represented special purpose acquisition company (SPAC) in Delaware chancery court litigation brought by the majority shareholder to block a $6.9 billion de-SPAC merger.

  • Represented defendant in New York Commercial Division litigation over plaintiff’s allegations of shareholder oppression, fraud, tortious interference with contracts, among other claims, related to the development of Mexican energy project.

  • Represented an online travel company in a suite of class and individual action lawsuits in multiple federal trial and appellate courts related to the Helms-Burton Act.

  • Defended a Latin American subsidiary of a major Spanish telecom provider in court in relation to a pathological arbitration agreement.

  • Represented a coffee producer that was expropriated by the Venezuelan government in an ICSID case, through the annulment proceedings.

  • Represented a real estate investor and meat processing group in the first ICSID case against Croatia.

  • Represented an infrastructure construction company investor in an ICSID case against Panama.

  • Represented Hungary in an ICSID case brought by a French investor that provided meal and food vouchers.

  • Represented a sovereign investment fund in U.S. proceedings under 28 U.S.C. § 1782.

  • Represented an individual in U.S. proceedings stemming from a broad 28 U.S.C. § 1782 application.

  • Represented the world's largest automotive safety parts supplier in relation to its post-bankruptcy litigation in federal, bankruptcy and state court actions in the U.S.

  • Represented numerous creditors in contested matters arising from bankruptcy cases (both foreign and domestic) in U.S. bankruptcy courts.
