Biography

Tracy van der Colff is a director designate in Baker McKenzie’s Employment & Compensation Practice Group in Johannesburg.

Tracy has spent time in Baker McKenzie's Frankfurt, Amsterdam and London offices working on high value cross-border transactions.

Practice Focus

Tracy has extensive experience in South African employment law, including employment negotiations and concomitant drafting, organisational restructuring, immigration and dispute resolution. Tracy's past experience as a State Prosecutor makes her a unique asset when representing clients before the Employment Tribunal in litigious matters.

Tracy's time abroad has developed her international client base and allowed her to gain invaluable experience dealing with the employment related aspects of multi-jurisdictional and cross border employee transfers.

Representative Legal Matters

  • Successfully opposed an unfair dismissal claim at the Employment Tribunal and successfully arguing for a cost order against the claimant.

  • Member of client's core advisory team for co-coordinating and advising on a multi-jurisdictional business acquisition spanning 136 jurisdictions.

  • Creating an innovative online immigration tool for a client, whereby the client can access pertinent and up-to-date immigration advice based on a specific set of facts in a matter of seconds.

  • Advising client on organisational restructuring and change management.

  • Acting for the buyer in a multibillion-dollar transaction spanning 22 jurisdictions and handling employment related carve-outs.

  • Acting for the seller in a multibillion-dollar transaction spanning 45 jurisdictions and handling employment-related matters such as business transfers, stock sales, reverse carve outs and employee transfers in eight jurisdictions.

  • Acting for the buyer in a multibillion-dollar transaction spanning 43 jurisdictions and handling employment-related matters such as including reverse carve outs, carve outs and stock sales in relation to 7 jurisdictions.
