Biography

Pavel Novikov is a partner in the Moscow office of Baker McKenzie. He focuses on domestic litigation and international commercial arbitration, specifically on insolvency and restructuring disputes. He represents clients in commercial, corporate and administrative (regulatory) disputes. He also acts on behalf of the clients in criminal investigations and cases.

Representative Legal Matters

Court Representation

  • Represented Codest Engineering S.R.L. in various proceedings related to a dispute between the client (the Contractor) and its counterparty (the Subcontractor) from a subcontract agreement for certain Works in VTB Arena Park project in the ICC and the Russian insolvency proceedings.
  • Represented the the insolvency administrator of OJSC TKS in the dispute against controlling persons of the large public utility company.
  • Represented a bankruptcy administrator of a Czech bank and then a foreign company, Gomanold a.s. (assignee of the Czech bank) to recover its Russian assets from the Russian debtor, energy supplier, and to foreclose upon collateral (i.e., mortgaged electric plant, gas station and underlying land plots).
  • Represented a bankruptcy administrator of a Czech bank and then a foreign company, Gomanold a.s. (assignee of the Czech bank) in court hearings where the court ordered the debtor to pay approx. USD 7.5 million and foreclosed on collateral - apartments in high-end residential compound valued at approx. USD 6.5 million.
  • Represented Novo Nordisk, one of a world leading pharmaceuticals producer, in the Russian insolvency proceedings of a former distributor.

Advising

  • Advised Shell in connection with Mariysky Refinery Insolvency.
  • Advised a large medical device manufacturer on the options to restructure the outstanding debt of its largest Russian distributor.
  • Consulted a large European bank with regard to potential claw-back claim of the insolvency administrator of a Russian bank, currently in insolvency liquidation, resulted in an extensive risks assessment and development of a preferable strategy.
  • Advised a client regarding recovery of the debt from a large Russian distributor, which was declared bankrupt.
  • Advised a client on the deal structuring due to potential insolvency of its customer.
