
Ilya Hoekerd
Biography
Ilya Hoekerd is the head of Baker McKenzie Amsterdam’s Immigration Desk. He practices in the areas of individual and collective employment and labor law, immigration law or global mobility, data protection law and mediation or alternative dispute resolution. Ilya regularly assists and advises high-profile employees, as well as local Dutch companies, publicly traded global multinationals and their works councils. In particular, he assists clients in multidisciplinary migration projects varying from one-off short-term business visits to the comprehensive and continuous transfer of employees.
Practice Focus
In the employment area, Ilya is proficient in matters involving cross-border employment, collective dismissal, transfers of undertakings, employment and labor law compliance, employee participation/consultation, works councils and trade unions, non-competition/non-solicitation, summary dismissal (termination for cause) and employment-related litigation. In the data protection area, Ilya advises on all aspects of European and Dutch data protection laws and regulations. He also assists clients in the implementation of related legal requirements, including the necessary filings with the Dutch Data Protection Authority and permit requests with the Dutch Minister of Justice. In his role as legal mediator, Ilya guides parties to build in-depth understanding of their mutual interests and their conflicting interests. Supported by Ilya's well-structured methods of dispute resolution, parties greatly increase the opportunity to discuss and find an amicable solution. The success rate of a mediation procedure ranges between 60 and 70 percent.

- Implements pragmatic and efficient immigration schemes to enable care free and prioritized employee mobility.
- Successfully represents clients in employment-related litigation, including, dismissal cases, interlocutory procedures, employer's occupational liability cases and several cases in relation to the (alleged) violation of non-competition restrictions.
