
Fabien Hecquet
Biography
Fabien Hecquet is a senior associate in Baker McKenzie's Energy, Mining and Infrastructure Group based in Paris.
Since 2011, he has worked on major projects in France and several African countries. His work has included the negotiation of public-private partnerships and energy and infrastructure projects between governments, private enterprises and financial institutions. Recent representations include also the review of regulatory aspects pertaining to the development and operation of wind farms in France and the review of equipment supply and construction contracts in relation with the potential financing of these facilities.
Practice Focus
Fabien's practice focuses on the energy, infrastructure, and mining sectors with a particular emphasis on energy-related investments (oil and gas and electricity, including thermal, nuclear, and renewable power production) and on transport-related investments (port and airport).
He advised public entities in the drafting and negotiation of concession agreements in relation to the construction of port and airport infrastructures in Africa and major industrial groups in the negotiation and drafting of industrial contracts and construction and investment contracts, on commercial aspects of partnerships, as well as mergers and acquisitions in the mining sector in Africa
Representative Legal Matters
- Advised China International Water & Electric (CWE) in the drafting and the negotiations of EPC, concession agreements, PPAs, and O&M contracts in relation to the 690 MW Kaléta and Souapiti hydropower projects and their transmission lines in Guinea.
- Advised African Infrastructure Investment Managers LTD (AIIM) in relation to the tender process launched by the Port Authority of Kribi for the concession of the Multipurpose Terminal in Kribi, Cameroon.
- Advised a Spanish utility giant on the acquisition of 100% of the share capital of a company operating 11 wind farms and also developing wind farms projects.
- Provided legal assistance to the Port Autonome de Conakry in the drafting and negotiation of a concession agreement between Albayrak Turzim Seyahat Insaat Ticaret SA and Port Autonome de Conakry.
- Advised the Government of Guinea in the call for tenders for the exploitation of the Simandou 1&2 deposits, among the largest iron-ore deposit in the world, and the assessment of the progress of Rio Tinto's mining project and the iron ore infrastructure of Simandou/Simfer (Simandou 3&4 deposits).
- Advised Port Autonome de San Pedro on the extension of the San Pedro Container Terminal by MSC Mediterranean Shipping Company into a Deepwater Transhipment Terminal.
- Advised RWL Water LLC in the drafting and negotiations of contracts pertaining to the procurement, construction, commission and maintenance of a Seawater Desalination Modular Unit in Mauritania.
- Advised a multinational technology company in relation to the review and negotiation of a power supply agreement for its facilities in France.
- Advised La Banque Postale in relation to the potential financing of wind farms in France, including the review of regulatory aspects pertaining to the development and operation of wind farms in France and the review of equipment supply and construction contracts.
- Advised the Government of Côte d'Ivoire on the 10-year concession of the ground handling services at Abidjan's Felix Houphouet-Boigny International Airport. After an international tender process, this concession was awarded to National Aviation Services, a Kuwaiti company
