Biography

Naiara Eizagarate is the Team Leader of the Intellectual Property and Media Law Department at Baker McKenzie.

Practice Focus

Naiara has expertise in setting up and negotiating the legal documentation for the financing of audiovisual productions and in drafting and negotiating a wide range of agreements for producers, audiovisual content providers and OTT platforms for the acquisition, sale and production of films and series.

Naiara also provides on-going legal assistance during the development, production, post-production and distribution phases of scripted and unscripted content. She performs chain of title analysis and advises studios on scripts clearances, identifying risks relating to trademarks, copyright, advertising, unfair competition/passing off, image/publicity rights and defamation.

In addition, Naiara has a track record of experience in dealing with Spanish copyright collecting societies for the clearance of rights on behalf of audiovisual media service providers. Areas of expertise: Transactional IP, Copyright, Media Regulatory and Non-regulatory Advisory.

Representative Legal Matters

  • Advises international studios on the on-going and future audiovisual projects they hold in the Spanish market throughout the entire lifecycle of the content. The financing of each of the projects in which she is involved vary from EUR 1-2 M per episode in the case of series and from EUR 10 million to EUR 116 million in the case of films.
