Baker McKenzie successfully represented a racking system manufacturer in a dispute against a warehouse operator for damages in the amount of EUR 10.7 million.
The warehouse operator brought a claim to the District Court Prague East against the racking system manufacturer seeking damages resulting from collapse of the racking system, whereby it claimed that the racking system was defective and did not comply with technical norms.
The first instance court dismissed the claim on merits. The warehouse operator filed an appeal, but the appeal court then stayed the proceedings for procedural reasons.
The case also involved aspects of German and English laws since the Warehousing Agreement between the warehouse operator and its customer was under German law and the Insurance Contract between the warehouse operator and its insurer was under English law.Baker McKenzie Prague team was led by Martin Hrodek (Partner), who was assisted by Martina Závodná (Associate) and Maximilian Sattler (Associate, Frankfurt office).
