Baker McKenzie advised UVita GmbH (future Vivy GmbH) on the tendering procedure "Electronic health platform" of BITMARCK Software GmbH, the leading provider of IT in the field of health insurances, substitute funds and trade guild health insurances. The start-up company prevailed against competitors with its healthcare app "Vivy" in an European-wide procurement procedure and won the contract.
UVita GmbH created the digital health platform and health assistant in an application called "Vivy". With the help of technology, the "Vivy" app enables anyone to better understand their own health and make more conscious and better informed decisions for their own well-being.
Vivy is the only integrated application that provides a space where medical records and health data are electronically collected using the highest standards of privacy and encryption technology. The Vivy app is designed as an open platform solution that allows selected stakeholders in the healthcare system to connect directly to the user. Through the combination of health and lifestyle data, Vivy provides its users and their physicians and practitioners with a holistic picture of their state of health.
Baker McKenzie comprehensively advised UVita GmbH as a competitor in the bidding process. In addition to the public procurement questions, advice was also rendered on IT contract law issues.
"By successfully winning the tender, UVita GmbH can pursue its goal to create a comprehensive solution for an open and at the same time secure digital ecosystem pertaining to the topic of health and can offer it to the overall market. In well-rehearsed cooperation with our client, we were able to provide the UVita team with help and advice at all times, even at short notice, and to contribute to the success", comments Baker McKenzie partner Prof. Susanne Mertens, who was in charge of the mandate.
