RealD Wins Claims in Patent Infringement Lawsuit
Baker & McKenzie represented the 3D market leader RealD Inc. in its patent infringement investigation against competitors MasterImage 3D, Inc. and MasterImage 3D Asia, LLC at the International Trade Commission.
On July 27, 2016, the Commission’s Notice finding a violation of Section 337 was published in the Federal Register. The Notice follows last week's Final Determination by the Commission that found infringement, validity, and domestic industry for three patents that were asserted against MasterImage (21 asserted claims were found infringed and valid).
Based on the findings, the Commission issued cease and desist orders directed at MasterImage and a limited exclusion order prohibiting importation of all seven of MasterImage’s accused products and their components. The Commission also set a bond in the amount of 100 percent of the entered value of excluded products imported during the period of Presidential review.
