On 14 December 2019, Executive Order No. 37/2019 (Executive Order) issued by the Federal Executive Branch (FEB) introduced changes to the export duties rates.
In 2018, the FEB had established a 12% additional export duty until 31 December 2020 (executive order No. 793/18), for all tariff codes of the Mercosur Tariff Schedule. Such export duties were subject to a cap of ARS 4 or ARS 3 for each USD (of the FOB value), depending on the tariff code.
The main points of the Executive Order are:
i. Removes the ARS 4 cap.
ii. Determines a new list of tariff codes that will be subject to a 9% export duty rate, without cap.
Considering the above, export duties for goods will apply as follows:
Definitive Export |
Applicable Export Duty Rate |
Tariff codes included in Annex I of the Executive Order, e.g., wine products. |
Ad valorem 12% export duty rate, with a cap of ARS 3 for each USD exported. |
Tariff codes included in Annex II of the Executive Order, e.g., dairy products. |
9% ad valorem export duty rate, without cap. |
Tariff codes not included above | 12% ad valorem export duty rate, without cap. |
