On 2 May 2017, the Decree of the Government of the Russian Federation dated 19 April 2017 No. 470 "On Changes to the Decree of the Government of the Russian Federation dated 2 November 2000 No. 841" came into force (Decree No. 470).
Decree No. 470 elaborates on and extends obligations of employers regarding training of employees in the area of civil defense.
As a reminder, according to the Decree of the Government of the Russian Federation "On Approval of the Regulation concerning training of population in the area of civil defense" dated 2 November 2000 No. 841 (Decree No. 841), employers must develop civil defense training programs and carry out training of employees, as well as create and maintain relevant training and material resources.
According to the changes introduced by Decree No. 470, employers must develop civil defense course training programs based on exemplary programs issued by the Russian Ministry of Emergency Situations and train their employees in such course training. To comply with this obligation, employers may rely on the Recommendations on organizing and conducting course training in the area of civil defense and emergency situations (approved by the Russian Ministry of Emergency Situations dated 2 December 2015 No. 2-4-87-46-11).
In addition, Decree No. 470 provides that employers, inter alia, must organize and carry out introductory briefings on civil defense with new joiners within the first month of their work.
Consequences for Employers
We recommend that our clients take note of the above legislative changes, and that they ensure compliance with the obligations in the area of civil defense. According to Section 2 of Article 20.7 of the Code of Administrative Offences of the Russian Federation, non-compliance with the obligations in the area of civil defense may incur an administrative fine of RUB 100,000 to RUB 200,000 (approximately USD 1,754 to USD 3,508) for a company and RUB 10,000 to RUB 20,000 (approximately USD 175 to USD 350) for officials.
