In May 2017, Brazil formalized it's request to become an OECD member. As a result, the need to bring the Brazilian transfer pricing (BTP) rules up to standard with the OECD Guidelines grew. Since then, the Brazilian tax authorities and the OECD joined forces to examine the similarities and divergences between the Brazilian and OECD transfer pricing approaches in order to set up a plan of action. This resulted in the publication of a joint presentation in April 2022 in which a series of rules guiding the new BTP system was presented.

Impact and opportunities

Many of these proposed changes in the BTP rules may impact European companies when doing business in Brazil. As the BTP rules will most likely be presented soon and enter into force either in January 2023 or January 2024, a window of opportunity arises to reassess your company’s’ transfer pricing model and corporate structure connected to Brazil. If changes appear to be necessary before the new BTP rules enter into force, not much time is left to restructure.
