The Federal Court of Australia delivered judgment in Australian Competition and Consumer Commission v. Trading Post Australia Pty Ltd [2011] FCA 1086 on 22 September 2011. The case illustrates the position of publishers who present but do not adopt claims in advertising but also highlights the risks for advertisers if using competitors' names in advertising.
