Success starts in the mind
Workshop in Dusseldorf on April 19, 2013
“Imagine that you started working as a Baker & McKenzie associate only two weeks ago. The phone is ringing and an extremely important client asks for asap legal advice in a complex transaction, which he needs for a board meeting that same night. Unfortunately, all of the law firm's partners are at the International Partners' Meeting in Istanbul where they are stuck in the middle of a crucial meeting at that moment. And now it is up to you to help the client.” This was the scenario of a case study approx. 30 young legal talent, amongst them many trainee lawyers and postgraduates, were confronted with in the scope of a workshop our law firm held in our Dusseldorf office on April 19, 2013.

“With this case example, which was not only designed as a quite realistic setting but covered several aspects of a complex M&A transaction as well as many pitfalls under cartel law, we provided our guests with a real-life picture of the challenges we frequently face as corporate lawyers of an international law firm,” says Christian Horstkotte, partner and head of the Cartel Law practice group of Baker & McKenzie Dusseldorf. He welcomed the participants in our office at Dusseldorf Medienhafen, introduced them to the world of Baker & McKenzie and showed them how the individual practice groups interact both locally and on an international level. of Corporate and Cartel Law together with the two associates Dr. Philipp Schütt and Jens Böhnke prepared the participants for the case example and explained to them some basic rules in transaction business: What are the first things to do when starting to deal with a tricky transaction? What are the best ways of understanding my client's strategy and of putting my knowledge into practice? What are the possibilities of structuring a transaction under corporate law? When does cartel law play a role? And what are the next steps to bring the transaction to a success?

The lawyers-to-be worked through the legally-complex case example in two teams. Afterwards, a discussion with the clients was simulated in which the participants were to present their strategy to “real” clients and to advise them. Dr. Holger Engelkamp and Helena Teichert acted as clients. The two lawyers, both of whom had been secondees in the legal departments of Baker & McKenzie clients - large DAX-30-enterprises - for half a year, were the perfect choice to take the roles of clients in a difficult transaction. And of course, they were also able to pass on their practical experience to the next generation of lawyers. “We have not offered such one-on-one talks with a “client” in any of our previous workshops”, comments Christian Horstkotte. The novelty was very well received both by the participants and the two associates who played the part of the clients. “The situation was critical. We, the clients, were stuck in the middle of a major legal problem when we found out that we might also incur a significant fine under cartel law. We had to present a piece of good news as soon as possible,” reports Corporate lawyer Dr. Holger Engelkamp. “It was great to see the enthusiasm of the participants of our workshop in tackling the issue, and how they approached the situation with really good, intelligent proposals for a solution.” They did not only demonstrate

their legal knowledge but also their soft skills, such as empathy, team spirit and rhetoric skills. “And this is exactly what it takes in our every-day routine,” says Cartel Law specialist Helena Teichert. Last but not least, the two associates reported on the personal experiences they made during their secondments. Then, in line with the workshop's topic “Success starts in the mind”, memory trainer Oliver Geisselhart taught the participants how to train their memory with effortless ease.
Cooking dinner with lawyers
Together with quite a number of lawyers of the Dusseldorf office, our guests finished the day with a cooking dinner, and had the opportunity of conversing with the lawyers. On the occasion of preparing a four-course meal, they demonstrated their cooking skills and showed that flexibility, creativity and team spirit are not only important when it comes to the legal profession but also when preparing a tasty meal. Insofar, the workshop produced only winners: 1. We, Baker & McKenzie, got to know quite a number of very interesting candidates. 2. The participants got an intensive impression of the work as a lawyer in a specific situation and met many lawyers both during the day and on the occasion of the dinner. 3. Everybody involved learnt to cook really well.

Dr. Ragnar Harbst - as in the year before - was given the award in the category Arbitration/Germany,
Dr. Dietmar Helms was rewarded for his performance in the category Securitization/Structured Finance/Germany and
Dr. Juergen Mark won the prize in the category Litigation/Germany.
Since 2005, the ILO Client Choice Awards are given to lawyers who distinguish themselves from competitors by the “excellent client care” and the “quality of the service” they provide. ILO identifies the winners exclusively on the basis of assessments handed in by corporate counsels.

Giving fresh impetus to children and juveniles – regarding school and their future career
Baker & McKenzie promotes the association “Studenten bilden Schüler e.V.”
Help domestically disadvantaged children and juveniles improving their performance in school and their future chances on the labor market - this is the aim of the association “Studenten bilden Schüler e.V.” founded in 2012, which Baker & McKenzie has started sponsoring just recently. “Through our project, we intend to contribute to the improvement of the educational opportunities of socially disadvantaged children and juveniles,” says Marina Miller, federal chairwoman of the association and student of education and American studies at the Goethe University in Frankfurt/Main.
About 1,350 students of all faculties have volunteered and committed themselves to the continuous promotion of these pupils in, by now, 25 locations throughout Germany. They give between one and two hours free extra tuition per week to a total of more than 1,500 children and juveniles in children’s homes and other social facilities. “In one-to-one tuition, we identify and deal with the pupils’ deficits in school and give fresh impetus to these young people to enable them to study independently,” Marina Miller explains the association’s concept. In addition, the students often organize leisure activities with their mentees, e.g. joint visits to museums.
According to Marina Miller, both the pupils’ and the teaching students’ feedback has been downright positive. “There has been very positive feedback from both sides, which shows us that we are on the right track with our project.” The association plans to extend its work to further locations in Germany in 2013. “We would be happy to find not only further sponsors but also volunteers who want to establish new local groups in university cities,” explains the chairwoman.
“Studenten bilden Schüler e.V.” is recognized as a non-profit association and works on a religiously unaffiliated and politically independent basis. It was founded in Frankfurt/Main in 2012. For further information on this initiative please go to www.studenten-bilden-schueler.de.
