      <description>The UK Supreme Court has issued its decision in the long-running NLA v PRCA dispute (the "Meltwater Case"), in which, in a unanimous judgment delivered by Lord Sumption, it has agreed in full with the arguments of the PRCA that temporary copies made in an end-user's browser cache and on-screen when simply viewing the content of a web page, as opposed to downloading or printing out the content, are exempted from copyright infringement by the temporary copies exception in Art. 5(1) of the Information Society Directive, implemented in the UK by s.28A CDPA 1988.</description>

      <description>Significant amendments to the Australian Customs seizure regime came into force this week. As foreshadowed in our previous Client Alert, the amendments address practical difficulties experienced by intellectual property owners by improving the system for seizing infringing goods, and identifying importers and exporters. Significantly, instead of an IP owner having to press designated owners to forfeit goods, the onus will now be on the designated owner to file a claim for release of the seized goods, failing which the seized goods will be destroyed by Customs.</description>

      <description>The Court of Justice of the European Union has ruled in ITV Broadcasting Ltd v TVCatchup Ltd that the live streaming of third party broadcasts requires the permission of the broadcaster, as such retransmission amounts to a "communication to the public" within the meaning of the Information Society Directive. Live streaming services, therefore, may not be able to continue to retransmit without paying licence fees to broadcasters. This ruling is significant as it provides further guidance on the concept of "communication to the public" and seems to be another step in the direction of affording greater protection for authors of copyright works through this right.</description>
