On 27 February 2012 the Ministry of Public Works and Services of the Government of the Federal District (the GDF) published International Bid Tender (IBT) No. LP/GDF/SOS/DGSU/CONCESIÓN/001/2012 (the Bid) to grant a concession for a term of 25 years for urban solid waste, property of the Federal District found at the IV Stage of the Bordo Poniente Landfill (the Landfill), to capture and use biogas generated by these wastes, to be used as fuel and/or to generate electricity (the Project), and to register the Project under the Clean Development Mechanism (CDM) of the Kyoto Protocol before the appropriate agency or before the respective bodies in the carbon credit markets, to obtain these credits and/or the applicable credits for the reduction of greenhouse gas emissions; all this in order to conclude the final shutdown of the IV phase of this landfill.

As announced a few days ago by Secretary of State Frédéric Lefebvre, the 2 percent tax will be shelved even before seeing the light of day. The bill for the Fourth Modified Finance Act for 2011, discussions on which start today at the French National Assembly, retroactively repeals, as of 1 November 2011 the tax introduced by the same lawmakers in September this year. This tax should therefore never be applied.

These rules contain 16 articles and are entitled Notice of the Ministry of Commerce on Issues relating to Cross-border RMB Direct Investment (Shang Zi Han [2011] No. 889) (商务部关于跨境人民币直接投资有关问题的通知)(商资函[2011]第889号) (the Notice).
