Eric Borysewicz is a partner in the Firm’s Litigation and Arbitration Practice Group in Paris. He represents clients in dispute resolution proceedings before state jurisdictions, as well as internal and international arbitration proceedings under ICC rules and other arbitration institutions. Before joining the Firm, Mr. Borysewicz was the managing partner of the dispute resolution/international arbitration practice of Courtois Lebel. He has also worked in the arbitration department of Gide Loyrette Nouel.
Practice Focus
Mr. Borysewicz focuses his practice on risk management issues, routinely advising on major litigation involving industrial and infrastructure projects, damages and claims as well as product liability litigation. He also assists clients with post-acquisition litigation and unfair competition and reputation piracy and advises on a broad range of transactional matters. Mr. Borysewicz is highly regarded for drafting and negotiating complex industrial and infrastructure project agreements, as well as renegotiating existing agreements following an unforeseen change in circumstances.

Eric Borysewicz rejoint, en qualité d’Associé, le Départment Litiges et Arbitrage de Baker & McKenzie SCP en mai 2010.
Il intervient tant en contentieux devant les jurisdictions étatiques qu’en arbitrage interne et international, notamment CCI.
Il est plus particulièrement spécialisé en gestion des risques industriels et notamment :
- Litiges et arbitrages internationaux impliquant des grands projets d’infrastructures ;
- Sinistres et contentieux industriels ;
- Responsabilité du fait des produits ;
- Construction ;
- Litiges post-acquisition ;
- Concurrence déloyale et parasitisme ;
Il assiste également les clients au stade du conseil et notamment :
- Rédaction et négociation de contrats complexes portant sur des grands projets industriels ou d’infrastructure et dans les secteurs suivants : énergie, gaz industriels, industrie chimique… ;
- Renégociation de contrats en cours.
Avant de rejoindre Baker & McKenzie SCP, Eric Borysewicz était Associé au sein du département Contentieux / Arbitrage du cabinet Courtois Lebel, département qu’il dirigeait depuis 1999. Il a également exercé, de 1989 à 1999, au sein du département Arbitrage de Gide Loyrette Nouel.
Il est l’auteur de l’article « Sous-traitance internationale et loi du 31 décembre 1975 : un mariage délicat » en collaboration avec Jean-Marc Loncle ainsi que de nombreux articles, dont certains publiés dans la rubrique juridique des Echos. Il est intervenu régulièrement dans les séminaires du réseau ALFA (American Law Firm Association) au cours desquels il traite plus particulièrement de la responsabilité du fait des produits et des contentieux internationaux.
Eric Borysewicz est titulaire d’un LL.M de Columbia University Law School à New York ainsi que d’un DEA en Droit privé de l’université d’Aix Marseille III. Il est membre des barreaux de Paris et New York. Eric Borysewicz parle couramment anglais.
