On June 16, 2010, Baker & McKenzie presented a review of the latest regulations published by PEMEX from January 6, 2010 (implementing the legislative amendments passed by the Mexican Congress in 2008). The focus of the presentation was to review the various elements of the regulations and specifically whether PEMEX may have been empowered to draft agreements with oil and gas companies that would allow payment on a volumetric basis that: 1.) create an economic interest for US federal income tax purposes; and 2.) allow booking of reserves for financial accounting purposes.
