Brian Hengesbaugh advises clients across various industries on global privacy and information management, data security and information technology matters. Formerly a special counsel in the US Department of Commerce, he helped develop and implement the US government’s domestic and international policy in the area of privacy and electronic commerce. He is listed in the Computer World Ranking of Top Privacy Advisors, and was cited for data privacy and security in the Legal 500 and Chambers USA. He also received an award from the US Department of Commerce for his outstanding accomplishment in negotiating the Safe Harbor Privacy Arrangement with the European Union. Mr. Hengesbaugh currently serves as member of the Firm’s Privacy Steering Committee.

Mr. Hengesbaugh's practice covers privacy and information management, with emphasis on regulatory and transactional issues such as cross-border data flows, data security and breach notification obligations, whistle-blower hotlines, e-monitoring, e-discovery procedures, outsourcing, marketing, jurisdiction, consumer protection and other privacy-related issues. He routinely works on sourcing and corporate transactions, global database and technology implementations, as well as privacy-related issues in litigation and government investigations.
