Baker & McKenzie Partner Unravels Antitrust and Competition Law in Modern-Day China with Exclusive Handbook

Global, 25 August 2011 - Baker & McKenzie partner H. Stephen Harris, Jr. has co-authored Anti-Monopoly Law and Practice in China, a first-of-its-kind handbook designed to demystify the practice of antitrust and competition law under the new systems enacted by China on August 1, 2008.

"The handbook aims to guide readers through China’s anti-monopoly law landscape in China in thorough detail. It aims to fill in the gaps and provides guidance on what to expect moving forward,” said Mr. Harris. “To this day, there are a lot of misconceptions and questions about how the law will be used in practice, especially given certain unique aspects of the Chinese economy and regulatory framework.  Companies need to be aware of these evolving issues when investing in China.”

Each chapter of the handbook includes practical advice on approaches to meet the challenge of complying with the law's requirements, including analysis of likely interpretations and applications of the anti-monopoly law based on precedents in related economic laws and actions by other administrative agencies. Where policy choices are uncertain, the text explores probable developments in China based on comparable applications of competition laws in other jurisdictions. Other co-authors of the book include Mark A. Cohen, a professor at Fordham Law School, and Peter J. Wang, Sebastien J. Evrard, and Yizhe Zhang, lawyers from Jones Day.  

Mr. Harris practices antitrust law, including class actions and cartel and merger investigations, before US and international courts and agencies. He also counsels on compliance with antitrust, FCPA and related areas of law and represents financial institutions in complex regulatory and commercial litigation. Mr. Harris handles civil and criminal antitrust litigation and cartel investigations in a broad range of industries, including financial institutions, pharmaceuticals, information technology, electronics, health care, consumer products, mining and minerals, retail, and software. He also has represented major money-center banks in numerous cases against US financial regulatory agencies. Mr. Harris has extensive experience in Asia and is licensed to practice law in both the US and the UK.
