On 9 December 2014, the Government of Singapore and the Government of the United States signed an intergovernmental agreement (IGA) to facilitate the implementation of the Foreign Account Tax Compliance Act (FATCA) in Singapore. The IGA is based on the United States Department of the Treasury's Model 1 IGA and was signed following the announcement in May 2014 that Singapore and the US have reached an agreement in substance regarding a Model 1 IGA. A copy of the IGA can be found on the website of the Inland Revenue Authority of Singapore (IRAS).

Some of the primary challenges facing multinational companies granting equity awards internationally center on practical issues that often go overlooked – (1) do award recipients need to “accept” their awards and if so, how can this be done? (2) what is the impact and requirements associated with changing the terms of outstanding equity awards for reasons ranging from changes in the law, reassignment to another country, enforcement of clawback provisions, or minimizing risks associated with prior legal/regulatory non-compliance; and (3) what are the advantages, disadvantages and requirements associated with implementing global recharge (or reimbursement) arrangements, under which the local entities are charged with the cost of the equity awards (typically to enable them to take a local tax deduction). This webinar will address these issues and will provide attendees with legal and practical perspectives on these often vexing questions, along with strategies for addressing them within the framework of their companies overall equity compensation strategy and administrative processes.

Companies are required to submit an annual report, Form RSS1, to the Irish Revenue in relation to certain types of equity awards granted to employees in Ireland. Generally, reporting is required for those awards where the employer does not need to withhold taxes. Both the grant of, and the taxable event related to, such awards must be reported. For the tax year 2014 and future tax years, the report must be submitted electronically.

On 5 December 2014, the State Administration of Taxation (SAT) released the 2013 China Advance Pricing Arrangement (APA) Annual Report (Annual Report). This fifth annual report focuses on China’s APA mechanisms, procedures and practices, and provides statistics for 2005 through 2013 accompanied by an analysis of the statistics. The Annual Report came after the SAT declared publicly in September 2014 that it would suspend APA negotiations with treaty partners through 2015. Many had anticipated that the SAT would delay publishing its annual report as well because the SAT is short-handed. The release of the Annual Report, although later than the customary target date of July 1, shows that the SAT is still committed to the APA program and the suspension is only temporary.

On 11 February 2015, Resolution of the Cabinet of Ministers of Ukraine On certain business deregulation matters No. 42 dated 28 January 2015 (the Resolution), came into effect. The Resolution has simplified the procedure to issue and renew work permits for foreigners and stateless persons (the Work Permit) by (1) providing an extended list of grounds for when recruiting foreign labor is considered appropriate and justifiable; (2) changing time limits for renewal filings of the Work Permit, and reducing the maximum amount of time allowed to issue, or to renew a Work Permit; and (3) establishing that a Work Permit can be prolonged an unlimited number of times.

Since 1 January 2015, the authority holder of a preemption right has the possibility to request documents from the owner of a building subject of a declaration of intention of sale and request the owner for the permission to visit the property. Such possibilities were introduced by the Alur Law dated 24 March 2014, now article L 213-2 of the French Urban Planning Code, which required implementation decrees.

The law is now fully in force with the adoption of decrees n° 2014-1572 and n° 2014-1573 of 22 December 2014, respectively establishing the list of documents which can be requested and the conditions under which the property may be visited.
