The State of Delaware is very close to enacting major revisions to its Abandoned and Unclaimed Property Law. This client alert focuses on some of those changes, which include a reduced look-back period for unclaimed property audits, reinstating interest, a permanent voluntary disclosure program, a new statutory notice requirement, and additional compliance burdens with respect to reporting unclaimed property. The legislation may offer opportunities to holders of Delaware unclaimed property that are currently unavailable under Delaware law. The bill has already been passed by both legislative chambers and is widely expected to be signed by the governor in the immediate future.

On 13 July 2015, Governor Brown signed urgency legislation amending California's paid sick leave law, which goes into effect immediately. The amendments (AB 304) are surprising to some, as California's paid sick leave law -- the Healthy Workplaces Healthy Families Act of 2014 (HWHFA) -- just went into effect two weeks ago on 1st July.

As mentioned in our previous alert, a new law called the Licensing Facilitation Act goes into effect on 21 July 2015. Essentially, the law requires all government authorities to provide a licensing manual for the public and obligates the authorities to comply with the manual which spells out the rules, procedures, and conditions for the submission of the application, the work flow and timeline for granting licenses, and a list of documents required for the application. It also prescribes an official's duties and liabilities in this regard.

The Mandatory Grain Port Code of Conduct (the Code) was introduced to address a perceived lack of flexibility in the previous Government regulation, the Wheat Export Marketing Act (WEMA). Even though it has only been in operation for little over half a year, the Code appears to be having that effect, with the Australian Competition and Consumer Commission (ACCC) already assessing four applications for reductions in regulation.
