Recently US Citizenship and Immigration Services (USCIS) has begun to rely consistently on the AACRAO Electronic Database for Global Education (EDGE) related to foreign degree-equivalency regulations to determine the US equivalent to a foreign degree. Historically, there has not been an identifiable uniform approach to foreign degree-equivalency regulations and policies for H-1B, PERM, EB-2 and EB-3 petitions and thus the government's reliance on EDGE has brought more stability and predictability to case adjudications.

On 27 October 2011, the House Judiciary Committee held a markup and HR 3012, the Fairness for High-Skilled Immigrants Act which was introduced by Rep. Chaffetz (R-UT), was reported favorably out of committee by a voice vote. This bill eliminates the employment based per-country cap entirely by fiscal year 2015 and raises the family-sponsored per-country cap from 7 percent to 15 percent.

Companies sponsoring workers for permanent residency through the PERM (labor certification) process, as well as those companies who request prevailing wage determinations from the DOL as a safe harbor in the filing of H-1B petitions, should be aware that DOL has currently suspended processing of all prevailing wage determinations as the agency is utilizing all its resources to comply with a 15 June 2011 court order regarding H-2B wage determinations.
