Immigration in China

As a global law firm, we understand that moving an expatriate workforce seamlessly across borders — including Greater China — is critical to business success.

Our award-winning global immigration practice assists multinational companies with the movement of personnel across multiple jurisdictions, including China, Hong Kong and Taiwan. We can advise on the use of available work permit and visa categories to help meet hiring and training needs, and prepare filings to secure work, residence and travel authorization for foreign national employees. We also assist companies in the development of immigration compliance programs, and advise on protocols for expatriate transitions in the case of major business change, including consolidation, reductions in force or reorganization.

In Hong Kong, our experience includes employment and employment (investment) visas, training visas, the Capital Investment Entrant Scheme, the Quality Migrant Scheme and right of abode (permanent residency).

In China, we can assist with securing business visitor and work visas, employment licenses, foreign expert certificates, employment permits and residence permits.

Through our one-stop service, our Immigration team works closely with our Employment and Tax groups to provide comprehensive advisory services relating to cross-border mobility.

Companies with employees who regularly work outside employers’ premises must comply with new requirements covering employment agreements, the performance of job functions, and the provision of technical equipment, among others. The new rules take effect on 19 April 2013.
Firm lawyers from our Employment, Global Equity Services, and Tax Practice Groups share insights into managing successful cross-border integrations while navigating different legal systems, employee rights and expectations. The article in the June 2013 issue of ACC Docket highlights corporate considerations, employment implications, and tax drivers with an emphasis on global integrations.
We highlight new work permit rules for non-EU nationals in Sweden, stricter penalties for illegal employment of foreigners in China, the effects of the Red-White-Red-Card on immigration in Austria, the slowdown of US immigrant visa allocations, as well as new immigration developments in Colombia.
