José Joaquín Ugarte is a member of Baker & McKenzie’s Arbitration & Litigation and Antitrust practice groups. Since 2004, he has been involved in numerous complex cases, including international and local arbitration and litigation. In addition to his practice, Mr. Ugarte has been a professor of Civil Law at the Universidad Católica de Chile Law School since 2005, and has also served as speaker in various national and international seminars on international arbitration, litigation, antitrust, civil liabilities, torts and others. Mr. Ugarte is a member of the Chilean Bar Association.

Mr. Ugarte focuses his practice on litigation, especially on international and domestic arbitration, as well as on antitrust litigation. He is particularly involved in civil, commercial, antitrust, constitutional, construction, regulatory, finance, environmental, mining, international trade, securities, insurance, insolvency, product liabilities, and pension fund matters.

Representative Legal Matters

• Represented an international company in mining law litigation related to a USD1.5 billion mining project before the Chilean Constitutional Court, Court of Appeals and Supreme Court.
• Participated in the defense of the Chilean Association of Isapres (private health insurance providers) before the Constitutional Court. This case determined the subsistence of the private health insurance system in Chile and was recognized by Latin Lawyer as its Latin America Deal of the Year in 2010.
• Represented a company accused of participating in a cartel on the Chilean luxury tourism market, before the Antitrust Court and Supreme Court.
• Represented an important international forwarding company in litigation proceedings related to civil liabilities and insurances.
• Represented a multinational company in litigation proceedings related to unfair competition.
• Represented one of the most important insurance brokers of Chile in arbitration proceedings related to acquisition of companies and non-compete clauses.
• Represented a concessionaire for the construction of a highway for USD300 million in environmental litigation against the Chilean state.
