The French government has passed a law requiring public electronic communications service providers to immediately notify the French data privacy authority of personal data breaches and to maintain an inventory of those breaches for review.
The Full Court of the Federal Court posted the next instalment in the iiNet battle, finding that iiNet had not authorised copyright infringement engaged in by its users. However, it is highly likely that this effectively will be another interim position given that the film studios and other content owners are expected to seek leave appeal to the High Court.
The Australian government has released an issues paper seeking public comment on whether a statutory cause of action for breach of privacy should be incorporated into Australian law. We discuss the current rights of individuals and key issues relevant to the proposed new statutory cause of action. Comment is to be submitted by Friday 4 November 2011.
