Dispute Resolution in Thailand

In today’s intensely competitive global marketplace, the stakes are higher, the deals are bigger, and avoiding and addressing legal disputes are critical facets of conducting business. Cross-border transactions introduce a host of variables, from conflicting laws to competing venues. Navigating them successfully requires a combination of global experience and local knowledge from practitioners who are adept across a broad range of business and legal issues, and are highly sensitive to the subtleties of custom and culture.

We have been successfully involved in a wide range of complex cases at various Thai courts, including the Tax Court, Bankruptcy Court, the Labour Court, the Intellectual Property and International Trade Court and the Administrative Court, as well as the Thai Arbitration Institute. We also coordinate with our offices in more than 65 locations worldwide to provide efficient multijurisdictional litigation assistance and advice. We can help with:

  • Construction – Preparing contracts, consulting on projects, resolving disputes between owners, project managers and contractors; initiating and defending claims; and seizing property and auctioning the same to satisfy debts
  • Banking and finance/restructuring and insolvency – Representing local and foreign banks and corporations in instituting legal action to recover under loans, bonds, promissory notes and other financial instruments and credit facilities; providing consultancy in the preparation and implementation of reorganization plans; representing creditors in claims and objections; advising on liquidations, auctions and foreclosures
  • Labor and employment – Representing multinational clients with Thai operations in labor relations matters and labor disputes — in particular discreetly negotiating settlements regarding human resources disputes, representing employers in the Thai Labour Court, and providing consultancy regarding work regulations, employee benefits and severance
  • Tax – Litigating objections to assessments of various tax and customs levies by the Revenue Department, Customs Department and other authorities, on behalf of local and foreign corporate clients
  • Administrative law – Representing persons and corporations in the Thai Administrative Court; seeking relief from grievances caused by acts of the government and its agencies; and handling claims under government concessions and contracts, revocation of by-laws, neglect of duty, and discrimination
  • Corporate and commercial disputes – Handling joint venture/contractual disputes and shareholder derivative actions; enforcing arbitration awards; and achieving amicable resolution of commercial disputes
  • Alternative dispute resolution – Helping resolve disputes through negotiation, mediation and arbitration in both domestic and international forums, including the Thai Arbitration Institute, the International Chamber of Commerce and the United Nations Commission on International Trade Law
