Biography

Teresa Tovar leads the Antitrust and Competition, Compliance and TMT groups in the Firm's Lima office, where she has been partner since 2007. She is also currently a member of Baker McKenzie's Latin America Antitrust and Compliance Steering Committees.

Practice Focus

Teresa focuses on data privacy and information technology issues, corporate compliance, antitrust, unfair competition and consumer protection. She has vast experience leading privacy compliance and general compliance programs, and she also focuses on anticorruption, antitrust as well as internal investigations and due diligence processes in several industries.

Teresa regularly sponsors companies in proceedings before INDECOPI for matters relating to antitrust, consumer protection, unfair competition and the elimination of bureaucratic barriers.

Her experience in data privacy, corporate compliance and competition law has been recognized by several prestigious international publications such as Chambers & Partners, Legal 500 and Leaders League.

Representative Legal Matters

  • Advised several clients on the implementation of the obligations imposed on their business by Law No. 29733, of Personal Data Protection and its regulations.

  • Advised an on-demand delivery company with regard to sanctioning procedures by the National Authority of Personal Data Protection.

  • Advised a social technology company regarding antitrust, unfair competition, consumer protection and privacy matters.

  • Advised an electronic products and solutions business company in assessing all data protection and consumer protection aspects of its new worldwide entertainment platform.

  • Providing general advice to various clients, both national and international, on issues related to personal data protection legislation.

  • Advising various national and international companies on the execution of projects for the implementation and/or improvement of privacy compliance programs and compliance programs in general. These companies are present in various industries, such as mass consumption, telecommunications, direct sales, real estate, banking and finance, mining, pharmaceuticals and medical materials, among others.

  • Assisted clients from diverse industries (software company, medical device company, construction company, among others) in the conduct of internal investigations for alleged inappropriate practices within their organizations.

  • Advised a major insurance company in carrying out a due diligence process involving anti-corruption aspects.

  • Conducted compliance training sessions for various clients.

  • Advised clients on conducting audits and on the implementation of antitrust compliance programs, as well as on leniency applications (early delation).

  • Assisted Azteca Comunicaciones Perú and TV Azteca in the bidding process for the concession to design, deploy, operate and maintain a fiber optic network that provides broadband connectivity throughout Peru.

  • Advised Compañía Marítima Chilena in a proceeding initiated by the Competition Authority (INDECOPI) in connection with an alleged cartel in the market of vehicle shipping services.
