Precedential Tax Cases
Baker & McKenzie’s participation in the first Polish case before the European Court of Justice is particularly worth mentioning.
Case C-313/05 was about the compliance of the Polish regulations on excise duty on passenger cars imported from other EU Member States. The ruling of the ECJ of 18 January 2007 left no doubt that the excise duty used was in conflict with EU law. The Polish taxpayer was represented by Jerzy Martini from Baker & McKenzie.
Recently, Jerzy Martini and Zbigniew Liptak, our tax advisers, represented a client in another precedential case before ECJ.
Case C-414/07 concerned compliance with EU law of Polish regulations relating to deduction of VAT assessment. In the opinion of the Court, a limitation of the taxpayers’ right to deduct the tax assessed on the purchase of fuel for automobiles was contrary to Community law.
