Our lawyers discuss the Supreme Court's ruling in NLA v. PRCA, in which the court gave its clear view that temporary copies made in an end-user's browser cache and on-screen when simply viewing the content of a web page, as opposed to downloading or printing out the content, are exempted from copyright infringement by the temporary copies exception in Art. 5(1) of the Information Society Directive, before referring the point to the Court of Justice of the European Union ("CJEU") for a preliminary reference in order that this "critical point may be resolved in a manner which will apply uniformly across the European Union".
This issue discusses the European Parliament's revisions to the European Commission's proposed changes to the Trade Marks Directive, which have made substantive amendments to a number of the Commission's original proposals, particularly in relation to the origin function and scope of infringement in double identity cases, the issue of counterfeit goods in transit and absolute grounds for refusal of a trade mark. We also look at OHIM's proposed common practice on the scope of protection given to black and white marks, recent CJEU case law concerning trade mark dilution and the latest word on government policy around plain packaging of tobacco products in the UK.
