Food Law in the Netherlands

Innovation and consumer awareness about the relationship between food and health have increased demand for functional and nutritional foods. This has a significant impact on the food and agricultural industries worldwide. The associated legal issues are crucial challenges for those industries.

We understand the importance of having legal advisers who understand the complexities of food law. At Baker & McKenzie, we have a well established Food Practice Group, which is dedicated to providing customised advice to food manufacturers and retailers.

Our Food Law team comprises practitioners from several practices, including EU & Competition Law, Corporate Commercial, Commercial, Regulatory & Trade and others. The team is part of our European Food Law Practice Group and provides the full range of services required by sophisticated food and agricultural companies. Our experience includes:

  • Representing a food manufacturer in the authorisation procedure for the marketing of novel foodstuffs
  • Advising an EU Member State on the legal aspects of a national safeguard measure issued against an unsafe meat product
  • Advising a major confectionery company on the presentation and labelling requirements for its products
  • Assisting a multinational tea and coffee manufacturer on all aspects of food law associated with the planned introduction of new products

This alert summarizes the provisions under the free trade agreement of the Commonwealth of Independent States, which took effect on 20 September 2012 in Russia, Belarus and Ukraine.
The legal requirements concerning direct marketing are becoming ever less transparent. What requirements do I have to comply with when I call someone or send an e-mail? This small guide outlines the “rules of the road” – the consent requirements for direct marketing under German law.
We provide an overview of the Customs Union’s new toy safety regulations, which set out requirements for raw materials, hygienic safety, packaging and labeling of children’s toys imported into, marketed and distributed in Russia, Belarus and Kazakhstan. The regulations took effect on 1 July 2012.
